Welcome to Themmie. These Terms of Service ("Terms") govern your access to and use of the Themmie marketplace, including browsing, purchasing, and selling digital products. By creating an account or using Themmie, you agree to these Terms.
1. Accounts
You must provide accurate information when registering and are responsible for all activity under your account and for keeping your credentials secure. You must be able to form a legally binding contract to use Themmie.
2. The marketplace
Themmie is a platform that lets independent authors sell digital products such as website themes, templates, UI kits, and related assets. Themmie facilitates the transaction, payment processing, licensing, and delivery, but authors are the creators and sellers of their products.
3. Purchases and licenses
When you buy a product, you receive a license to use it under the terms provided with that product. Each purchase is issued a unique license key and one or more downloads. Unless stated otherwise for a specific product, licenses are non-exclusive and non-transferable, and you may not resell, redistribute, or sublicense a product as-is.
4. Payments
Prices are listed in US dollars unless otherwise noted. Payments are handled through our third-party payment providers (including PayPal). By purchasing, you authorize us and our providers to charge your selected payment method.
5. Refunds
Because products are digital and delivered instantly, all sales are generally final. You may submit a refund request if a product is materially not as described, is broken, or cannot be downloaded. Refund requests are reviewed on a case-by-case basis and, if approved, refunded to the original payment method.
6. Selling on Themmie
Authors are responsible for ensuring they own or have the rights to everything they publish, that their products do not infringe third-party rights, and that listings are accurate. Themmie retains a commission on each sale as disclosed in your author dashboard, and pays out the remaining balance according to our payout schedule.
7. Acceptable use
You agree not to misuse Themmie, including by uploading malicious code, infringing content, or unlawful material; attempting to bypass licensing or payments; scraping or abusing the platform; or interfering with other users. We may remove content and suspend or terminate accounts that violate these Terms.
8. Intellectual property
Products remain the property of their respective authors. The Themmie name, brand, and platform are our property. Nothing in these Terms transfers ownership beyond the license you purchase.
9. Disclaimers and liability
Themmie is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Themmie is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for the product giving rise to the claim.
